From cruisers to sport bikes, and everything in between, chances are you’ll find a bike that suits your lifestyle. After all, what could be more perfect than roving the open roads of California atop your own personal machine? But it may not be all fun. If you’ve bought a defective motorcycle and it is stuck in the shop instead of roaming the open road with you, it may be time to see what protections exist under California’s Lemon Law.

Lemon Laws are intended to protect consumers from defective vehicles and ensure that they receive compensation for their troubles. What Is the Motorcycle Lemon Law?

A Motorcycle Lemon Law is a state statute that protects consumers from purchasing defective motorcycles. These laws generally require manufacturers to repair or replace faulty bikes within certain time frames, or after a certain number of attempts. If the manufacturer fails to meet this requirement, the consumer can sue for damages or get their money back.
In general, if you purchase a new or used motorcycle with problems beyond your expectations of normal wear and tear, you can return it to the dealership for a full refund or replacement within a certain amount of time (usually one year). The Motorcycle Lemon Law applies only to motorcycles that are defective in manufacturing or design. It does not cover defects caused by misuse or neglect on your part. To qualify for a State’s Motorcycle Lemon Law, you must meet all of the following criteria:

There must be proof that the defect began within the warranty period.
The motorcycle must have been purchased from a dealership or another retailer.
The motorcycle must have a warranty that covers defects in materials or workmanship.
The manufacturer must have been given a reasonable amount of time (typically 30 days) to fix the problem and failed to do so.
The manufacturer has at least twice attempted to fix the problem that substantially interferes with the motorcycle's use, value, or safety.

How Do I Know if My Motorcycle is a Lemon?

Many defects could indicate that your bike is a Lemon. Common signs of motorcycle lemons include:

Aftermarket parts were installed to fix a defect
The clutch feels loose and doesn't engage properly.
Mechanical issues, like a loose chain or faulty brakes
The bike won't start and must be towed away for repair.
The engine overheats within the first few miles of riding.
The brakes are ineffective and often lock up on the road.
Electrical problems, such as short-circuits and faulty wiring
Engine failure, especially if you must replace the engine or have it rebuilt
The bike has had more than one recall notice issued by the manufacturer or dealer.
The bike has repeated failures of the same part, such as multiple blown tires or broken clutch cables.
The bike has been in the shop so often that it's been out of commission for more than 30 days in a 12 month period.
The manufacturer refuses to make repairs under warranty or denies coverage when they should have covered the repair.

What Is Not Covered by Motorcycle Lemon Laws?

The Motorcycle Lemon Law covers all types and makes of motorcycles, including scooters and mopeds. It also applies to leased or rented motorcycles if they are commonly used for personal transportation or recreation. The Motorcycle Lemon Laws do not cover all defects. Some problems may not be covered if they happened outside of the warranty period, or result from abuse, or neglect, by the owner.

While Motorcycle Lemon Laws may be able to help you if your bike has mechanical issues, they won’t help you if your motorcycle is stolen or vandalized. This is because these situations aren’t considered defects in the product itself, they are outside of its manufacturer’s control. In addition, the bodywork of a motorcycle is not covered under any State’s Lemon Law. So, if your bike has an issue with its paint job, or dents in the body, these issues will not be covered by your State’s Lemon Law.

Motorcycle Lemon Laws also don’t apply if you’re using your bike for commercial purposes, such as renting it out, or using it in an Uber or Lyft ride-sharing service. And finally, these laws don’t cover any damage caused by improper maintenance on your part, such as failing to change the oil every 3,000 miles.

The accessories on a motorcycle are also not covered under any State’s Lemon Law. This includes helmets, tires and other equipment that comes with the vehicle when purchased.
